Human rights advocate Femi Falana and his son, musician and activist Folarin Falana, better known as Falz, filed the lawsuit. A previous report from 9JAROKS stated that VDM attended court in red traditional attire, accompanied by enthusiastic supporters, while the Falanas were conspicuously absent.
The case was postponed because essential applications from both sides had yet to be added to the court file.
Justice Matthias Dawodu, ruling on an ex parte motion on October 14, underscored the Falanas' legal right to be shielded from defamation. He directed VDM to delete a video, posted on September 24, 2025, that allegedly defamed the Falanas. Additionally, the judge barred VDM from posting any further defamatory videos or comments regarding the Falanas on his social media channels until the case is heard.
In addition, the judge directed that all case documents be served on VDM via his attorney, Deji Adeyanju. The Falanas are each seeking N500 million in damages, accusing VDM of falsely alleging that they accepted N10 million from Idris Okuneye (Bobrisky) to obstruct justice. They argue that VDM intentionally circulated unverified information to harm their reputations.
Arguing that denying this request: contending that rejecting this appeal, asserting that turning down this petition, claiming that refusal of this request.
He stressed the necessity of appellate court intervention to ensure the judicial system's integrity, stating, "A refusal to grant leave may result in enforcing a decision that does not accurately apply the law, leading to detrimental consequences not only for the parties but for the administration of justice as a whole."
